GENERAL TERMS AND CONDITIONS OF USE

These General Terms and Conditions of Use of the gamerspix Blog reflect the way our services – Infoproducts, are presented to our users and which laws, regulations or policies are applied. They apply globally to this Term and to the use of the Blog, the Privacy Policy, Disclaimer, E-mail Marketing Terms of Use, and also the SMS Terms of Use available at the domain: www.gamerspix.com. It is important to emphasize that regardless of any data provided by the User in the QUIZ, gamerspix DOES NOT INTERFERE in any process involving the analysis or approval of credit offered by partners, so that the final decision to carry out any business, grant credit or offer is exclusive to them and, furthermore, in accordance with their criteria, credit and risk policies.

What can you expect from our content (Infoproducts)? Information with general tips related to the financial and investment markets, which may present services and offers, directed by our partners, to improve your financial life.

DEFINITIONS

“USER” is any individual – 18 (eighteen) years of age or older, sole owner and holder of a valid electronic address registered on a platform – PROVIDER; that supports the electronic correspondence service (E-MAIL), and also, sole owner and holder of a valid telephone number registered in Brazil – with any of the operators authorized by ANATEL – National Telecommunications Agency, both provided by the same in our “QUIZ”, through a social network – Facebook or Instagram. “QUIZ” is the platform (service/technology/API) used, through the User’s consent, to collect data, namely name, electronic address (e-mail), telephone number, and estimates aimed at the User’s financial life. “INFOPRODUCTS” – Information and general tips about the financial market and services to improve financial life, from our partners in the same area and, also, in the investment sector. “E-MAIL MARKETING” – is the platform (service/technology/API) that sends out Infoproducts and includes any and all situations or agreements in which the Blog gamerspix, authorized by the User; sends one or more text messages to a specific email address provided in the “QUIZ”. “TEXT MESSAGING SERVICE – SMS”, is the platform (service/technology/API) that sends out Infoproducts and includes any and all situations or agreements in which the Blog gamerspix, authorized by the User; sends one or more text messages to a specific phone number provided in the “QUIZ”. “OPT-IN” refers to registering, subscribing, requesting, agreeing and consenting to receive one or more electronic messages from our team. “gamerspix”, means the Blog that manages the sending of EMAILS with the contents of Infoproducts.

ACCESS

The gamerspix Blog provides links – by sending messages (SMS or E-mail Marketing) to its domain (www.gamerspix.com), to Users, who, in turn, by accessing the domain (www.gamerspix.com), may be directed to other websites related to the financial and investment markets. In which the User may, by free and spontaneous decision, contract or not the services or products of the respective companies, without any interference from the gamerspix Blog. The User, by reading and accessing the website, AGREES to respect the General Terms and Conditions of Use, as well as all other terms (SMS and E-mail Marketing) and Privacy Policy mentioned above. By registering through our “QUIZ”, providing their information – name, e-mail address and telephone number, and “ACTIVATING” the receipt of our Info-product services, the User agrees and accepts the conditions of these terms.

USER ATTENTION WHEN BEING REDIRECTED

If the User is redirected to the partner website, the User must READ CAREFULLY all information provided by the partner, as well as the Terms and Conditions of Use and the Partner’s Privacy Policy. We emphasize that the Gamerspix Blog is not responsible for: the general terms and conditions of use and privacy policy of the partners; the information on the services and products advertised by them; the services and products eventually offered or contracted from the partner companies. The User must maintain good practices regarding information security when browsing and accessing the Internet: accessibility through secure equipment, updated antivirus and software and a secure network. The Gamerspix Blog is not responsible for any losses and damages resulting from the user’s irregular use of and browsing the Blog, and for unforeseeable circumstances or force majeure. The Gamerspix Blog does not send or request deposits or bank transfers for the granting or approval of any financial product. The gamerspix Blog does not send emails or SMS to the User with executable attachments (for example: .exe, .scr, .zip, .rar extensions), nor links for downloading. If you receive one, DO NOT click on the attachment and notify us through the blog itself. Without prejudice to the other provisions of these Terms of Use, the User IS PROHIBITED from violating any third party rights when using the gamerspix Blog, using the blog for the purpose of monitoring or harassing third parties; engaging in fraudulent, illegal, dishonest or improper activities when using the website. We value the “unique” relationship with our USERS, therefore, these terms are conditioned on the USER’s waiver of composing any CLASS ACTION. Furthermore, if the USER disagrees with part or all of these terms, we will present the ARBITRATION solution (Law No. 9,307 of 1996) prior to any judicial solution.

CONTACT US

The User has this service available to clarify all their doubts, solve any problems and present complaints or other information about the information products made available by the gamerspix Blog, exercise their rights in relation to the data provided, through the website itself in its “CONTACT” tab. However, if they prefer, REVOKE their consent regarding the processing and storage of the data provided, they can contact the DPO (Data Controller: Suamy M. APPLICABLE LEGISLATION

These Terms shall be interpreted and understood in accordance with the Portuguese language and its meaning. The legislation applicable to this contract shall be that which is applicable and in force in Brazil, in conflicts between the USER and the Infoproducts Blog (gamerspix), the order of preference shall be Law No. 9,307 of 1996 – Arbitration, safeguarding the provisions of Law No. 8,078 of 1990 – Consumer Defense Code. In the event of refusal to compose Arbitration to resolve conflicts with the USER, the forum to settle any legal conflicts shall be the city of Belo Horizonte – MG.

DATA REGULATION

By agreeing to receive our Infoproducts service, you accept the conditions for collecting, processing and storing your data – name, email address, telephone number, regulated by the General Data Protection Law – LGPD (Law No. 13,709 of 2018). However, you may at any time REVOKE your consent regarding the processing and storage of your data by sending messages to the DPO (Data Officer: Suamy M. Nascimento) at the email address:  [email protected] .

UPDATING THE TERMS AND CONDITIONS

The General Terms and Conditions of Use of the gamerspix Blog may be updated, supplemented or replaced at any time and for any reason, at the sole discretion of the Blog, without prior notice or notification to Users. Any User who DOES NOT ACCEPT these terms and conditions, which are MANDATORY AND BINDING, must refrain from using the gamerspix Blog.
